Frequently asked questions
From amounts and deadlines to weather excuses and vouchers: these are the answers to the questions travellers ask us most.
About Tomo Flight Claim
What does Tomo Flight Claim cost?
Nothing upfront and nothing if we lose. Only when a claim pays out do we keep a fixed percentage; you see that percentage in advance, with no hidden costs or subscription.
How long does a claim take?
If the airline pays straight away, often within a few weeks. If it refuses, formal notice and possibly court follow and it can take months. You follow every step live in your dashboard.
What details do you need?
Your flight number and date are enough for the check. For the claim itself we ask for your booking confirmation or boarding pass and a digital signature.
Is my data safe?
Yes. We use your data solely to handle your claim, in line with the GDPR. See our privacy policy for the details.
Can I claim for my whole travel party?
Yes. You add fellow travellers to the same claim; each signs digitally and each is entitled to the full amount, children with their own seat included.
I already claimed myself and was rejected. Is it still worth it?
Often, yes. Airlines initially reject many claims with boilerplate excuses. We test the excuse against real data and push on where individuals usually stop.
Flight delayed
Read the full page →How much compensation do I get for a delayed flight?
For a delay of 3 hours or more at your final destination: €250 for flights up to 1,500 km, €400 up to 3,500 km and €600 for longer flights. The amount is per person and independent of your ticket price.
Does the delay count at departure or arrival?
At arrival. The Court of Justice counts the moment at least one aircraft door opens at your final destination. A flight that left 2:55 late but arrived 3:05 late is therefore claimable.
Am I also entitled to food, drinks and a hotel?
Yes. From 2 hours of waiting the airline must provide care: meals, drinks and communication. If your flight moves to the next day, that includes a hotel with transfers. This is separate from the compensation.
What if the airline blames bad weather?
Bad weather is only a valid reason in genuinely exceptional circumstances. We test every weather excuse against the official METAR data for that moment at that airport; if it does not check out, we simply keep claiming.
How long after the flight can I still claim?
It varies by country: 2 years in the Netherlands, 3 in Germany and up to 6 in some countries. So check your flight even if it was a while ago; the check is free.
Does it cost me anything if the claim fails?
No. We work no win, no fee: only for a successful claim do we charge a fixed percentage of the compensation. No subscription, no hidden costs, no risk.
Flight cancelled
Read the full page →Do I get my ticket refunded and compensation?
Both are possible. A refund or rebooking is a basic right for every cancellation; the €250 to €600 compensation comes on top if the cancellation was within 14 days of departure and there was no force majeure.
The airline offered me a voucher. Do I have to accept it?
No. A voucher requires your explicit consent. You always have the right to choose a cash refund, within 7 days.
What if I only heard at the airport that my flight was off?
Then the cancellation counts as not announced in time and your compensation claim is at its strongest. Keep your boarding pass and every message from the airline; we do the rest.
Does a strike count as an extraordinary circumstance?
Usually not. The Court of Justice ruled that a strike by the airline's own staff is not force majeure. Only external causes, such as closed airspace, can be.
I was rebooked and arrived 5 hours late. Claimable?
Almost certainly. If you arrived well outside the legal time windows, the full compensation amount stands, even though you accepted the rebooking.
What does your help cost?
Nothing upfront and nothing if we lose. Only for a successful claim do we keep a fixed percentage of the payout. No win, no fee.
Denied boarding
Read the full page →How much compensation for an overbooked flight?
€250 for flights up to 1,500 km, €400 up to 3,500 km and €600 beyond. The right arises immediately when you are refused against your will, with no waiting period.
I gave up my seat voluntarily. Can I still claim?
The fixed compensation then lapses; you fall back on what you agreed with the airline. If you doubt whether it was truly voluntary, for instance under pressure at the gate, put your case to us.
Does denied boarding apply if I checked in late?
No. You must have checked in and been at the gate on time under the airline's conditions. If you were late because of a delayed connecting flight on the same booking, that is different; check your case for free.
May an airline refuse me for medical or safety reasons?
Yes, for legitimate reasons such as safety, health or missing travel documents the right to compensation lapses. Overbooking emphatically does not fall under that.
What should I do at the airport itself?
Ask for written confirmation of the refusal and its reason, keep every document and accept no offer without knowing what the law owes you. We handle the rest afterwards.
Missed connection
Read the full page →My first flight was only 40 minutes late. Can I claim?
Yes, if those 40 minutes made your connection impossible and you therefore arrived 3 or more hours late at your final destination. Arrival at the final destination is all that counts.
My connection was outside the EU. Does the regulation still apply?
Yes. If your journey departed from an EU airport on a single booking, the whole journey falls under EU 261/2004, even with a stopover in, say, Doha or Istanbul. That follows from the Wegener ruling.
I booked the flights separately. What now?
Separate bookings are legally separate journeys; the missed second flight is then usually not claimable. Do check whether the delay of the first flight itself was claimable.
Over which distance is my compensation calculated?
Over the straight line from your origin to the final destination of the entire booking, not per individual flight. Intercontinental journeys therefore almost always fall in the top €600 category.
The airline gave me a hotel. Does that cancel my compensation?
No. Care such as a hotel or meals is a separate right and offsets nothing. The €250 to €600 compensation stands entirely apart from it.
Compensation calculator
Read the full page →What details do I need for the calculation?
Just your flight number and the date. If you no longer know the flight number, you can search by route; the checker then shows that day's flights.
Is the calculated result binding?
The result is a legally grounded assessment based on real flight data, distances and weather reports. The final amount follows from the claim itself; the legal framework with the three fixed amounts is set in the regulation.
Is the amount per booking or per person?
Per person. Every passenger with their own seat is independently entitled to the full amount, children included. You add fellow travellers to the same claim with one signature each.
Why could my amount be halved?
Only on flights over 3,500 km: if the airline rebooked you to arrive within 4 hours of your planned time, it may halve the €600 to €300. Comparable 2 or 3 hour rules apply to shorter flights.
My flight cannot be found. What now?
Then you can enter the details manually; we verify the flight afterwards in additional sources. Even flights from several years back can usually be traced.
EU Regulation 261/2004
Read the full page →What exactly are 'extraordinary circumstances'?
Events beyond the airline's control that could not have been avoided with all reasonable measures, such as extreme weather or closed airspace. Technical faults and strikes by the airline's own staff do not count, according to the courts.
Does the regulation cover flights to and from the UK?
After Brexit the UK adopted the regulation almost one-to-one as UK261. And if you depart from an EU airport, the EU version simply applies.
Must the airline inform me of my rights?
Yes. Article 14 obliges airlines to display your rights at check-in and hand out a written notice during disruptions. In practice that rarely happens in full.
Can I claim damages on top of the fixed compensation?
Yes, extra costs such as a hotel or replacement transport the airline should have covered can be reclaimed separately with receipts. The fixed compensation is a minimum, not a ceiling.
Where do I complain in my country?
Every EU country has a national enforcement body for EU 261/2004, listed on Europa.eu. For actually getting paid, a civil claim is usually more effective; we handle that entirely.
